States Pursuing Climate Disclosure-Related Enforcement

Winston & Strawn’s “Increasing Enforcement of Climate-Related Disclosure Obligations” advises that state attorneys general (AGs) are actively pursuing investigations and litigation against companies for alleged climate-related disclosure omissions or misstatements. The memo, which summarizes pending litigation against companies filed by AGs in Connecticut, Delaware, DC, and Minnesota, identifies which industries have been predominantly targeted to date and likely future targets based on a comment letter submitted in response to SEC former Acting Chair Allison Herren Lee’s request for input on climate change disclosure by these 12 AGs: California, Connecticut, Delaware, Illinois, Maryland, Massachusetts, Michigan, Minnesota, New York, Oregon, Vermont, and Wisconsin.
