Bloomberg Tax reported that more than a dozen large companies, including Estee Lauder, Oracle, Eli Lilly, Beyond Inc., and Penn Entertainment Inc., have received comments from SEC staff on their climate-related disclosures in their SEC filings over the past three months. The nature of the comments purportedly is consistent with the staff’s sample letter to companies issued in September 2021 and subsequent comment letters (see, e.g., our prior reports here and here). Notably, in response to staff comments regarding distinct information included in sustainability reports vs. SEC filings, according to Bloomberg, most companies indicated that the reports were aimed at different audiences.
