A Holland & Knight partner interviewed for the article analogized the absence of disclosure about worker safety-related problems, coupled with an affirmative disclosure about the importance of worker safety, to the fact pattern pursued by SEC Enforcement in the recent Activision Blizzard case, and cautioned companies to consider their disclosures accordingly.
