This memo from Thomson Hines: “New Guidance on SEC Cybersecurity Reporting Regulations” explains a Policy Notice and related Guidance issued by the FBI on December 6 that discusses how a company should request a delay or a delay extension of public disclosure of a cyber incident for “national security” or “public safety” reasons under the new SEC cybersecurity disclosure rule (see our blog here); the FBI’s associated responsibilities upon receipt of such a request; and its interaction with the DOJ.
