Unsubstantiable Sustainability Claims Are Risky

Bloomberg Law reported on the rising number of suits against companies targeting allegedly false or misleading sustainability statements and the risks associated with making unsubstantiated or unsubstantiable marketing claims—particularly “100%”-related claims. According to the article, more than 17 cases involving misleading sustainability claims were filed from June 2021 to June 2023. Pending litigation against four companies involves the following statements: “100% sustainably sourced,” 100% sustainable,” “100% ethical sourcing,” and “100% green.”
