The Wall Street Journal reported on how companies are changing their DE&I-related practices in response to the US Supreme Court’s June 2023 college admissions affirmative action decision and associated DE&I-related backlash. Specifically, the article discusses behind-the-scenes (i.e., not advertised) changes in how programs and initiatives are being described and reduced demographic data-gathering to mitigate litigation risk.
Consistent with our prior reports, it appears most companies are not backing off diversity-related commitments, but rather may be rebranding them and making adjustments in how and where they talk about them in a manner that addresses legal and reputational concerns and challenges and other external pressures.
